LGBTIQ+ asylum applications rejected on unlawful grounds

A report examining 2,000 different decisions and judgments in asylum cases of LGBTIQ+ persons between the years 2012–2020 shows that the Swedish migration authorities have continued to reject applications of LGBTIQ+ people on grounds that are contrary to Swedish law as well as EU law and the UN refugee agency UNHCR's guidelines.

The Migration Agency and the migration courts require asylum seekers to give a detailed account of their "internal process" to sexual identification. The report criticises this requirement as it is based on stereotypical ideas about LGBTIQ+ people and on the assumption that there is a common experience to all of them.
